Parties are completely free to apply for Mediation, to continue the process, to conclude the process or to give up this process and must first agree to conclude the dispute through Mediation.
For these reasons, the parties can not by any means be forced into this process, and after a certain period of time, the parties can give up Mediation to resolve the dispute.
On the other hand, the parties have equal rights both during the application to Mediation and also during the process of Mediation. During the process one of the parties can not be excluded and the right to speak can not be restricted.
The Mediator manages both sides according to the principle of making their own decisions.
The principle of making his own decisions means that the parties will make decisions about the process and the results with their own free and enlightened wills, voluntarily and without being under pressure, including the choice of the Mediator, the formation of the process, participation in the process or withdrawal from the process and the results. For this reason, the parties can apply the principle of making their own decisions at every stage of the Mediation.
Within the scope of this rule;
(1.1) The Mediator must provide information about the Mediator's function in this process before or during the first session. The Mediator should emphasize that the decision-making power is on the parties rather than on the Mediator.
(1.2) The Mediator shall not give legal or professional advice to the parties in relation to the legal dispute.
(1.3) The Parties shall make their own decisions for the shaping of the process and shall have equal rights during this period, this is a fundamental principle of mediation practice. The Mediator is obliged to manage a quality process in accordance with this principle and to observe the principle of giving the parties their right to make their own decisions without being affected.
(1,4) The Mediator, due to public pressure, the pressures of the media or other persons, can not damage the right of any party to make their own decision.
